Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Porter visitor management platform ("Service") provided by Porter ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms. If you do not agree, you must not use the Service.

2. Service Description

Porter is a cloud-based visitor management platform that enables organisations to manage visitor check-ins, contractor compliance, host notifications, badge printing, and related workplace security functions. The Service includes web-based dashboards, kiosk interfaces, APIs, and integrations with third-party services.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised access to your account
  • Ensuring that team members added to your organisation comply with these Terms

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Collect or process personal data in violation of data protection laws
  • Transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorised access to the Service or its infrastructure
  • Interfere with or disrupt the Service or servers
  • Use the Service for surveillance or monitoring purposes beyond legitimate visitor management
  • Resell or redistribute the Service without our written consent

5. Payment and Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

  • Prices are per location and include all features
  • We may change pricing with 30 days' notice
  • Failed payments may result in suspension of the Service
  • You are responsible for all applicable taxes

All fees are due in advance. Refunds are not provided for partial billing periods. Free trials last 14 days and do not require a credit card. Billing disputes must be raised within 30 days of the charge by contacting our support team.

6. Data Processing

When you use the Service, you act as the Data Controller and we act as the Data Processor for visitor and employee personal data. Our processing of personal data is governed by our Privacy Policy and Data Processing Agreement. You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining necessary consents from visitors.

7. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is owned by Porter and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes. You retain ownership of all data you upload to the Service.

8. Warranties and Disclaimers

The Service is provided "as is" and "as available". While we strive to maintain high availability and reliability, we do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

The Service is provided "as is" without warranties of any kind, express or implied. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

9. Limitation of Liability

To the maximum extent permitted by law, Porter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising from your use of the Service. Our total aggregate liability shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

In all cases, our total aggregate liability shall not exceed the fees paid by you in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold Porter harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

Either party may terminate the agreement at any time:

  • You may cancel your subscription at any time from your account settings. Access continues until the end of your current billing period.
  • We may suspend or terminate your access if you violate these Terms, with notice where practicable.
  • Upon termination, we will retain your data for a reasonable period to allow export, after which it will be deleted in accordance with our Privacy Policy.

Upon termination, your data will be available for export for 30 days. Within 30 days of account termination, all personal data will be permanently deleted in accordance with our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
